Was in a certain CD mega store today. Saw a CD box set thing that my dad would love. Original price €60, reduced to €50 (sticker on it).

It scanned in as €60 so I said to the fella, no its marked at €50. he checked with the manager who said it was a mistake and it was €60. I said that it was my consumer right to be sold it for the marked price. I asked to speak to the manager who gave me a shpeel about consumer laws etc .... basically, I had to pay the full whack cos it was an error on the sticker. I got flustered and f*cking accepted it. Truth be told, I would pay €60 for the item cos my dad will love it and if it was anything else, I'd have put it back and not bought it..... but the principle is that I know my rights and I should have been given it at the marked price.

Girls, what can I do. I'm raging with myself for letting it go and accepting the managers word. I know its only a tenner difference, but I should have stuck to my guns. Should I complain to the consumers board or the head office of the store itself. Kicking myself...... :bomb:

No, they don't have to sell an article at the price on the label. It's not a contractual obligation at that point. Many places will let you have the item at the reduced price, but that's a (sensible!!) goodwill gesture rather than an obligation. Scanning systems in stores take away a lot of the discretion that sales assistants had in this area, which is a pity.

I never buy an item where the price isn't what it says on the label, but that's just my stubborness!

Ta girls,

I agree Quite Contrary..... normally I would have put the item back on principle, but its something that my dad would love and I hadn't a clue what to get him for xmas.... so I was under pressure......

The manager basically said what you said..... was just wondering if it was true.

Oh I know how how annoyed you must be with yourself, it's easy to get flustered when faced with a manager and their attitiude.

If I were you I would write to head office or general manager - say how disgusted you are to have been charged that amount when the sticker said otherwise, you were in the right - they have to charge the price on the item - it's not your fault they made a mistake.

Say that you are annoyed and won't be giving them your custom again! you never know you might get some vouchers in time for christmas!

I've complained a few times for genuine things and you do get results as long as you go to the highest person possible - they care about their customer relations.

It may well be false advertising, but that's a different area of law and it doesn't compel them to sell you the article at the advertised price, unfortunately.

Just googled this - couldn't believe you aren't entitled to the price on the item - apparently the price is "an invitation to treat"???

You can offer a lower price and they can reject it or they can charge higher than it says on the item as long as you aren't being misled and if you are informed of the correct price before you purchase!!! Very confusing.
Apparently the consumer has no real rights in this area!

When i worked in a large retail store (a good few years ago) managers were always so careful to make sure items were priced correctly and if they weren't we had to give the customer the price on the ticket..

In saying all that it is very bad customer service and they should have given it to you at the marked price. IMO. So I would still write to head office.

The store is in the right, legally. Sorry.

In STEPS- the legal process goes like this:
The price marked on the item is an 'invitation to treat' -

you bring it to the desk and 'make an offer' (usually the marked price)

the representitive of the company either 'accepts' or 'declines' your offer
in exchange for the item.

he exchange of your money for their item with a view to making a binding contract is called 'consideration' - (the trading of one thing for another) at the 'point of sale'

until BOTH parties agree to make that exchange, there IS no contract-
you're not obliged to hand over your money, and they're not obliged to hand over the item.

It's sucky, but it's that way to protect the consumer in the first instance (the case was Boots Chemists- if you want to google it :lookround: ) from being FORCED to pay money JUST for putting an item in their basket (and then, later say, changing their mind and putting it back on the shelf.)

I know its annoying, but its a sensible protection for sellers. What if something was €100 and someone mistakenly put €1.00 on the label?

If you were legally entitled to get the item at the advertised price, businesses would go bust with the amount of scams people would pull!

This has happened to me a few times and in all cases I got the item at the labelled price. However, at practically the same instant the remaining items were checked and corrected. It was very bad customer service not to let you have it for the 50 euro - look at all the bad publicity it has generated.

This happened to me before and it was in Music shop aswell. A sticker had been stuck on a CD and I wanted to buy it for my brother. It scanned in at more than the sticker said and I gave the spiel about being allowed to purchase it at the price stated on it. I thought that was the way it went too, but apparently not. They have to cover themselves in the shops too and they had a new assistant who started that morning and he had put all the stickers on the wrong CDs. I had to pay fuull price :(
